Acticon Technologies Awarded Permanent Injunction, Treble Damages, Attorney Fees in Patent Suit Against Lycom, Advance Creative

SUFFERN, NY, February 26, 2008 - General Patent Corporation (GPC) announced today that it obtained a permanent injunction, treble damages and attorneys' fees in its lawsuit against Lycom and Advance Creative, an important victory in its patent enforcement campaign on behalf of its subsidiary, Acticon Technologies LLC (Acticon).

Acticon brought a patent infringement suit against Lycom Technology, Inc. (Lycom) and Advance Creative Computer Corp. (Advance Creative), both of Taiwan, in the U.S. District Court for the Southern District of New York (Case No. 06 Civ 4316). Two other defendants, Heisei Electronics Co., Ltd. of Taiwan and Heisei USA, LLC of Azusa, CA, ultimately agreed to settle the lawsuit and to take a license under the Acticon patents.

Lycom and Advance Creative, however, failed to answer the Complaint, and a default judgment was entered against them. After an inquest on damages, the Court found willful infringement and ordered compensatory damages, treble damages for willfulness, and pre-judgment interest. The Court also found the case exceptional and ordered defendants to pay attorneys' fees and costs, and issued a permanent injunction barring these defendants from selling the infringing products in the U.S.
